  LDV PRIVACY POLICY

  This Privacy Policy sets out how Ateco collects, stores, uses and discloses personal information in accordance with the Australian Privacy Principles contained in the Privacy Act 1988. The Principles govern the use of "personal information", which is information or an opinion about an identified individual or an individual who is reasonable identifiable. It need not matter that the information is correct or not or whether it is recorded in a material form or not.

  Ateco's Privacy Policy allows you to:

  • correct your information; and
  • contact us if you are concerned with how your information is being used.

  In this document 'Ateco' refers to Ateco Automotive Pty Limited (ABN 34 000 486 706). Ateco are the Official Importers & Distributors for Warn Winches and LDV vehicles in Australia. Ateco distributes and sells a range of vehicles and related products in Australia through its appointed dealer networks.

  Your personal information

  Personal information collected and held by Ateco about you, may include:

  • name;
  • gender;
  • date of birth;
  • address;
  • telephone numbers;
  • e-mail address;
  • occupation;
  • drivers licence number;
  • drivers licence state;
  • ABN;
  • purchase details including credit card and banking information;
  • warranty and service transaction information provided by our dealer network, affiliates or third parties;
  • employment application information; and
  • any other relevant information.

  If you choose not to provide us with your personal information, we may not be able to provide you with the services you require, or the level of service on which we pride ourselves.

  How we collect personal information

  Ateco collects personal information in a number of ways, including:

  • directly from you, when you provide information by telephone, electronic messages (including email and SMS) or in documents;
  • directly from you, via our internet site (requests for information, Drive Chat) or through interaction with our various social media platforms;
  • from our dealer network when you purchase a vehicle or have your vehicle repaired;
  • from your agents or representatives who act on your behalf;
  • from competition entry forms or at our promotional activities or sponsored events;
  • from third parties we contract to collect and/or manage data on our behalf;
  • from third parties who you have asked or permitted to provide your personal information (including those parties from whom you purchase goods and services);
  • from marketing organisations, including through the use of purchased lists;
  • from industry databases;
  • from publicly available sources such as the Internet and telephone directories; and
  • from law enforcement, dispute resolution, statutory and regulatory bodies.

  Information we collect automatically

  Whenever you visit or interact with Ateco's website or other online platform of ours ("Platforms"), we, as well as any third-party service providers and/or advertisers, may use a variety of technologies that automatically or passively record information about how the Platform is accessed and used ("Usage Information").

  Usage Information may include:

  • your IP address or other unique identifier for the device used to access a Platform ("Device Identifier"),
  • email address, username, or other unique user identifier ("User Identifier"),
  • aggregated multi-platform information about Google users who have enabled personalised advertising on their Google accounts (Google Signals Data)
  • browser information,
  • "Device" type (computer, mobile phone, tablet or other device),
  • operation system and/or application version,
  • date and time of visit, pages viewed, preceding page views and your use of features or applications on the Platform such as interactions with connections or groups.

   

  Usage Information helps us keep our Platforms relevant to users and allows us to tailor content to a user's interests. Usage Information is generally non-identifying, but if we associate it with you as a specific and identifiable person, we will treat it as personal information.

  We may use Device Identifiers and User Identifiers to help us administer Platforms, diagnose problems with our servers, analyse trends, observe Platform usage and activity over time, help identify you, provide you with access to a personalised view of our Platforms, and gather broad demographic information for aggregate use.

   

  Cookies (data files placed on a Device when it is used to visit a Platform) may be used to associate you with media platforms like Meta (such as Facebook, Instagram and LinkedIn), Google Marketing Platform (GMP) and other media, and, if you so choose, enable interaction between your activities on our Platforms and those social media platforms.

   

  Pixels (small graphic images placed embedded on our Platforms) may also be used to help us and our third party service providers understand how you interact with our Platforms.

   

  We or third parties may place cookies on your Device for security purposes. We or third parties may also place cookies on your Device or use Pixels on our Platforms to facilitate site navigation and personalise your experience while visiting our Platforms (such as allowing us to select which ads or offers are most likely to appeal to you, based on your interests, preferences, location or demographic information).

  To learn how you may manage cookies, or delete cookies that have already been installed, please refer to your browser's help menu or instructions. If you disable or opt out of receiving cookies, some features and functions on our Platforms may not work properly or fully because we may not be able to recognise and associate you with your Ateco account(s). In addition, the offers we provide may not be as relevant to you or tailored to your interests.

   

  Remarketing: We may use Meta, GMP, Google Analytics, and other media publishers to advertise our products and services online. Third party vendors, including Meta, GMP, and other media publishers, use cookies to display relevant ads based on your past visits to our website(s). Remarketing allows us to tailor our marketing to better suit your needs and display ads that are relevant to you. We respect your privacy and any data collected will be used in accordance with this Privacy Policy, Meta's privacy policy, Google's privacy policy or the privacy policy of other remarketing services that we may use.

  If you do not wish to participate in our Remarketing, you can opt out by visiting the Network Advertising Initiative opt-out page www.networkadvertising.org or by clicking on the "Your AdChoices" symbol within advertisements.

   

  How we use your personal information

  Your personal information may be used in order to:

  • provide and market products and services for the brands Ateco imports and distributes, and to provide and market products of our related companies and dealerships (whether directly or through our related companies and dealerships);
  • communicate to you in relation to our products, services and our promotional activities;
  • purchase from you;
  • support your purchase through warranty and roadside assistance (whether directly or through our dealerships);
  • comply with our legal obligations (ie. in the event of a Vehicle Safety Recall);
  • monitor our performance and to help us manage our services;
  • identify and contact individuals who do business with us;
  • train our employees, agents, dealers and representatives;
  • research to improve our websites, products or services;
  • conduct customer and market research and analytics to improve the quality of our products and services;
  • assess and process employment applications and manage employment issues; and
  • handle complaints and disputes; and detecting, investigating and preventing fraud.

  We may contact and communicate with you either via telephone, post, facsimile, email or SMS.

   

  Direct marketing

  Ateco may send you direct marketing to inform you about products or services, special offers, programs, promotions and events that may be of interest to you. These marketing communications may include joint promotions with Ateco dealerships or other promotion partners, and may be sent to you using any contact details provided by you, such as post, phone, email or SMS.

  We will not direct market to you unless you have been given an opportunity to opt out of receiving future direct marketing communications or unless you have otherwise consented to direct marketing. If you do not want to receive such offers from us or do not want us to disclose your personal information to our related entities or dealerships for marketing purposes, you can opt out at any time by contacting us using our contact details provided below. We do not use or disclose sensitive information for the purposes of direct marketing.

   

  When we disclose your personal information

  We may disclose your personal information to organisations outside of Ateco. These organisations may include:

  • our appointed dealers;
  • outsourced service providers who manage services we provide to you including:
    -roadside assistance -customer research -financial services and insurance -mailing systems;  direct marketing and promotions; and -market research;
  • government, regularity, law enforcement authorities, organisations, as required or authorised by law;
  • our related bodies corporate;
  • the agent(s) of any of those entities referred to above;
  • your employer (where applicable); and
  • our advisors (including legal and accounting advisors).

  Those entities are not authorised by us to use personal information for anything other than the purpose for which we supplied that information to them. We may also disclose personal information where you consent to us doing so. That consent may be written, verbal or implied from your conduct.

   

  Disclosure to overseas recipients

  Our related entities and some of our service providers (including information technology service providers) may be located overseas and, as a result, personal information collected and held by Ateco may be transferred overseas. The countries in which these recipients may be located will vary from time to time, but may include Italy, France, China, New Zealand, United Kingdom, United States of America, and Korea.

   

  How we hold and store your personal information

  Ateco may hold your personal information in a number of ways, including:

  • in our computer systems or databases, which may involve storing data on storage or computer systems provided by third party suppliers;
  • in paper records; and/or
  • in telephone recordings.

  Where it has been collected from our or your agent, or our service providers or dealerships, they may also hold copies of your personal information. We may combine personal information we receive about you with other information we hold about you. Ateco will store your personal information in a secure environment. It's protected by a combination of physical and technological measures. We have taken all reasonable steps to carefully protect your data from loss, misuse, unauthorised access or disclosure, alteration or destruction.   1. What personal information about you do we collect and hold?

  We may collect and hold personal information about you. This includes:

  • your name, address, email, telephone number, date of birth and other information about you such as age and gender;
  • credit related information when you apply for credit from us or we get a credit report about you;
  • details about your vehicle purchase and servicing such as purchase date, purchase details, vehicle registration, name of selling dealer, service history and repair, warranty and recall details;
  • information you give us, such as when you contact our Customer Service Centre, login to our website, or call our roadside assistance;
  • from marketing campaigns, product surveys, and research, when you access and use our social media platforms and any publicly available information;
  • any other personal information we have to collect to identify you;
  • details in identity documents given to us, such as passport number, driver's licence number, Medicare card number; and
  • payment details including bank account, credit card details and other payment information if you buy our products and services.

  We will only collect sensitive information about you if you agree, unless the law lets us, or when the law says that we must collect it. Sensitive information includes information about your religious beliefs, ethnic origin, race and health.

  Usually we collect personal information about you from you and from LDV dealers who received information from you.

  We may collect personal information about you:

  • when you take part in promotions, competitions, customer surveys, and sponsorships;
  • when you fill in order forms for a vehicle, parts or accessories, or book your vehicle for servicing;

  • when you contact us about any of our products and services; or
  • from related companies, dealers and our service providers(such as Roadside Assist).

  We may also collect personal information about you from other people such as:

  • your accountant or employer, when required, as part of your credit assessment;
  • any personal referee provided by you;
  • any credit provider that gave credit to you, to assess your credit application;
  • any credit reporting body that gives us a credit report about you;
  • your insurer or broker;
  • our agents;
  • any government authorities;
  • marketing agencies and marketing lists; and
  • other people you refer to us or who refer us to you.

  We collect, hold, use and disclose your personal information for:

  • meeting our obligations to you (including warranty, recall, and roadside assistance) as the owner or driver of a vehicle;
  • answering your inquiries or comments;
  • customer service and product development;
  • to assess your application for credit;
  • to assess your application for a product or service;
  • deciding whether to offer you additional credit or to renew credit;
  • developing, administering and managing our services and businesses;
  • promotions and marketing including direct marketing;
  • research to improve our websites, products or services;
  • any other customer support purposes;
  • dealing with complaints;
  • complying with laws. These laws include:
    • the Anti-Money Laundering and Counter-Terrorism Financing Act 2006, which requires us to collect personal information about you when verifying your identity;

  • to Ateco Automotive Pty Limited, ACN 000 486 706 and LDV dealers, but only if they use it for the same purposes as set out above and only in connection with the LDV dealership franchise;

  • if you have applied for credit from us:

    • to identity verification vendors including credit reporting bodies who use your government identifiers (for example your driver's licence number or passport number) to verify your identity for us;

    • with your consent, to guarantors or proposed guarantors if a credit arrangement is or will be guaranteed.

  Your personal information may be given to our parent company in Japan, our related companies and our service providers that are located or hold data elsewhere in the world, including New Zealand, United Kingdom, Thailand and United States of America. If it is disclosed to an overseas recipient, we will only do this if we have taken reasonable steps to ensure that overseas recipient will engage with the personal information in a way that is consistent with the Australian Privacy Principles and our instructions or where we reasonably believe they are subject to laws that protect your personal information in the same or substantially the same way as the Australian Privacy Principles.

  We will take reasonable steps to protect and keep secure the personal information we hold.

  If personal information held by us is lost or there is unauthorised access or disclosure, we will investigate. We will also notify the breach to the Information Commissioner and affected individuals if we are required to do this under the Privacy Act.

  We may contact you with marketing material about our other products or services, special offers, promotions and events that may be of interest to you. We can do this if you have agreed, or when you would reasonably expect that your information would be used or disclosed this way.

  1. What credit information about you do we collect and hold?

  The kinds of credit information that we may collect and hold about you includes information (other than sensitive information) that may be provided to us from a credit reporting body, including:

  • identification information such as name, any alias or previous name, date of birth, gender, current or last known address and 2 previous addresses, and driver licence number;
  • information about consumer credit provided to you including the name of the credit provider, whether the credit provider is an Australian credit licensee, the type of consumer credit, the day on which the consumer credit is entered into, the terms or conditions of the consumer credit that relate to repayment, the maximum amount of credit available under the consumer credit, and the day in which the consumer credit ends;
  • information about whether or not you met an obligation to make a monthly payment of consumer credit, the day on which the payment is due, and the day on which the payment is made;
  • a statement that an information request has been made to a credit reporting body in relation to you by us;

  Your rights under the Privacy Act in relation to credit-related information include:

  • You can get the credit reporting body's policy about the management of credit-related personal information by contacting it. See contact details above.
  • You can access credit-related information that we hold about you from us, if you want to request us to correct the information, or make a complaint.
  • You can request a credit reporting body not to use credit reporting information about you for pre-screening of direct marketing by a credit provider.
  • You can request the credit reporting body not to use or disclose credit reporting information about you if you believe on reasonable grounds that you have been or are likely to be a victim of fraud.

  Your credit information or credit eligibility information may be given to our parent company in Japan. If it is disclosed to an overseas recipient, we will only do this if we have taken reasonable steps to ensure that overseas recipient will engage with the credit information in a way that is consistent with the Australian Privacy Principles or reasonably believe they are subject to laws that protect your personal information in the same or substantially the same way as the Australian Privacy Principles.

  We will also take adequate measures to ensure that the information is handled by the overseas recipient in accordance with the Privacy Act and our instructions.
